ACCC increases focus on franchising: How recent amendments will affect you

Melissa Trotter, Ross Zaurrini and Ayman Guirguis of Blake Dawson report on the recent amendments to the Franchising Code of Conduct:

  • Obligations on franchisors have been increased by recent amendments to the Code and to the TPA more generally. Expect to see further changes over the coming months including criminal penalties for individuals involved in cartel conduct and the possibility of regulation of the cumulative effect of small or “creeping” acquisitions.
  • It is an appropriate time for franchisors to re-acquaint themselves with their obligations under the TPA. Failure to do so risks raising the ire of a re-invigorated and well-funded competition regulator which takes an active interest in the franchising sector.
