Baker & McKenzie - SPORTSBOY deceptively similar to SPORTSGIRL BOY and SPORTS KIDS

Baker & McKenzie reports that Sportsgirl successfully opposed a trade mark application for SPORTSBOY on the grounds that it was deceptively similar to Sportsgirl’s trade marks SPORTSGIRL BOY and SPORTSKIDS.

According to Baker & McKenzie, the hearing officer found that the onus shifted to the applicant to show that the trade mark would not confuse or deceive following:

(a) the applicant’s alleged statement in a meeting with Sportsgirl that he believed there should be a “Sportsboy” for guys;
(b) together with the common use of GIRL/BOY coinages in trade marks,
(c) and particularly given the “undoubted” reputation of the SPORTSGIRL trade mark.
