Federal Court considers copyright in project homes

Marina Lloyd Jones, Senior Associate of Allens Arthur Robinson reviews Barrett Property Group Pty Ltd v Metricon Homes Pty Ltd [2007] FCA 1509 in which the Federal Court issued a detailed judgment on copyright in project homes. According to Marina Lloyd Jones, architects and builders seeking to incorporate a feature taken from another building into one of their designs, even if it is only the way commonplace rooms are arranged, should obtain legal advice before proceeding. A feature that is distinctive enough to merit copying may also be original and substantial enough to warrant copyright protection.
