Infringement where counterfeit packaging but genuine goods?

CCH reviews Brother Industries, Ltd v Dynamic Supplies Pty Ltd (2007) AIPC 92-262, in which the Federal Court determined that the importation and sale of unbranded goods in packaging bearing a trade mark that was not applied by the trade mark owner, amounted to trade mark infringement. This was the case even though the goods were genuine.
