Optus TV Now, copyright later (Clayton Utz)

Mary Still and Nicole Landerer of Clayton Utz report on Singtel Optus Pty Ltd v National Rugby League Investments Pty Ltd (No 2) [2012] FCA 34 regarding the Federal Court’s decision on copyright in broadcasts and Optus’ TV Now service.
According to Clayton Utz, Justice Rares found that Optus’ TV Now service did not infringe copyright in the broadcasts of the AFL and NRL games in the particular ways. However, other issues still need to be resolved, such as Optus’ technology for Apple devices.
Mary and Nicole note that proceedings are adjourned so that the parties can agree on the formal orders that need to be made to reflect the Court’s decision. Telstra and the sports organisations have been granted leave to appeal to the Full Federal Court.
