Solicitor/In-House Counsel - Commercial Litigation

With the option of working either in-house (full or part-time) or on retainer, you will be required to take complete charge of the handling of all legal affairs. This includes court appearances (mostly confined to the Local and District Courts and occasionally in IRC ) in matters relating to breach of contracts by clients and contractors in particular related to Confidentiality,IPR and restraint of trade/employment terms and debt recovery.

The Responsibilities:

* Drafting, reviewing and negotiating employee, sub-contractor and client agreements; Establishing Contract Management procedures to ensure disputes are minimized and parties meet agreed obligations;
* Continuously assessing the commercial relevance of standard contractual agreements and initiating the redrafting of agreements in conjunction with user groups, where appropriate;
* Providing commercial/contractual advice in problem areas arising out of and in the course of the companies’ business; Pursuing legal action against defaulters for breach of contract including recovery of debts; Attending to employment-related issues in IRC; and
* Drafting, reviewing and negotiating commercial lease agreements.

The Job Specific Requirements

* Demonstrated experience in a legal role, ideally pertaining to the Recruitment or Services Industry;
* Strong knowledge base and practice experience in Contract and Corporations Law, including insolvency, IP and related areas and the related Court procedures, and particularly on debt recovery matters in the Small/general Claims in Local and District Courts of NSW;
* Superior negotiation skills with proven ability to negotiate terms of agreement within demanding time frames;
* Ability to interpret contractual terms and conditions and manage competing priorities and demands of the business;
* Excellent communication skills, both verbal and written.
* Commercial exposure as part of prior legal experience would be highly regarded, as would knowledge of Immigration and Employment Law.
