Chris Bird is a patent and trade marks attorney with expertise in all aspects of patent work, particularly in the computer science and engineering disciplines. Chris Bird has extensive experience in matters relating to the use and exploitation of intellectual property rights through licensing and other commercialisation routes for a number of significant clients. Chris’s primary areas of responsibility in our patent and trade marks attorney group include the drafting and prosecution of patent applications, patent opposition work, and advice on patent validity and infringement matters, predominantly in technical fields relating to computer technology and advanced engineering. He represents a wide variety of clients both local and overseas, and has been working closely with companies such as Australia Post, Paper Australia, Sensis, Vividas Technologies and Mitsubishi Australia.

Sportsgirl wins against Sportsboy
Partner Chris Bird and Senior Associate Peter Ryan of Allens Arthur Robinson review the Australian Trade Marks Office decision of Sportsgirl Pty Ltd v Filip Sali [2007] ATMO 71 of 22 October 2007. Prior use of the unregistered trade mark SPORTSGIRL BOY on jewellery and prior use of the registered trade marks SPORTSGIRL and SPORTSKIDS for clothing were found to be an obstacle to registration of SPORTSBOY for clothing.

Patent duty of disclosure requirements abolished
Partner Chris Bird and Senior Associate Anthony Selleck of Allens Arthur Robinson report that the requirement to inform the Australian Patent Office of the results of prior art searches conducted by overseas patent offices has been abolished for all applications, except those that were advertised as accepted prior to 22 July 2007.

Progress in Australian patent reform in defences to infringement - Chris Bird, Partner, reports on the progress in legislative reform of the Patents Act 1990 regarding exemptions to infringement of a patent for experimental use and crown use. Specifically, the update relates to the Advisory Council on Intellectual Property’s (ACIP’s) publication in November 2006 of an Overview of Responses to the Public Consultation Paper.
