Fight over Big Apple

Apple Inc has challenged NYC & Company Inc’s trade mark application for the “Big Apple” logo, which morphs the symbol for infinity with the outline of an apple, a stem and a single leaf and is used to promote energy efficiency and recycling as part of New york’s GreeNYC program. According to Apple, the big Apple Logo is confusingly similar to its Apple logo and will cause dilution of the distinctiveness of the Apple trade mark. However, New York claims that it is using a logo that plays off its Big Apple nickname and has asked the Trademark Office to reject Apple’s challenge and cancel one of Apple’s logos on the groudn that it was acquired through fraud and is not being used for its intended purpose.
